These terms cover your use of BeforeNow. By using the app or this website, you agree to them. Last updated 14 August 2026.

BeforeNow ("BeforeNow", "we", "us") is operated by Mercatura Holdings LLC. These Terms of Service ("Terms") are a legal agreement between you and Mercatura Holdings LLC governing your use of the BeforeNow mobile app, this website, and related services (together, the "Service"). If you do not agree, please do not use the Service.

The service

BeforeNow surfaces historical information about the place you are standing, drawn from open archives. It is provided for general interest and education. Historical content can be incomplete, contested, or wrong; we present it in good faith but do not warrant that any particular fact, date, or account is accurate. Do not rely on the Service for navigation, safety, legal, or emergency decisions.

Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service. If you are under the age of majority, you may use the Service only with the involvement of a parent or guardian.

Your account and content

Some features require signing in with your email address. You are responsible for keeping access to your email secure and for activity that happens under your account. Tell us promptly if you believe your account has been accessed without your permission.

Acceptable use

  • Don't use the Service to break the law, harass others, or infringe anyone's rights.
  • Don't attempt to disrupt, reverse-engineer, scrape at scale, or gain unauthorized access to the Service or its data.
  • Don't resell, redistribute, or present the Service's content as your own.
  • Use common sense about your surroundings — stay aware of traffic, private property, and hazards while exploring.

Purchases, subscriptions, and ads

BeforeNow may offer a free tier supported by advertising (including optional rewarded videos you choose to watch), along with subscriptions and one-time unlocks. Purchases are processed by the applicable app store or payment processor and are subject to their terms. Subscriptions renew automatically until cancelled; you can manage or cancel through your app store account. Except where required by law or an app store's policy, payments are non-refundable.

Intellectual property

The BeforeNow name, logo, app, website, and original design and text are owned by Mercatura Holdings LLC and protected by law. Underlying historical content is drawn from third-party open archives (such as Wikipedia, Wikidata, OpenStreetMap, and Wikimedia Commons) and remains subject to their respective licenses. We grant you a personal, non-exclusive, non-transferable license to use the Service for your own non-commercial enjoyment.

Third-party services

The Service relies on third-party sources and platforms (open data archives, map and imagery providers, app stores, ad networks, and payment processors). We are not responsible for those services, and your use of them is governed by their own terms and policies.

Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee the Service will be uninterrupted, error-free, or available in every location.

Limitation of liability

To the fullest extent permitted by law, Mercatura Holdings LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim, or twenty US dollars.

Changes

We may update the Service and these Terms from time to time. Material changes will be posted on this page with a new effective date; continuing to use the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.
